TERMS AND CONDITIONS / PRIVACY POLICY

These are our Terms and Conditions. These are, together with all the references they contain, applicable to every agreement that we, Afra Amba (KvK-number: 34352930), create with you. Should you have questions, please do not hesitate contacting us via info@afraamba.nl. We have the right to change these Terms and Conditions. You agree that the last version of these Terms and Conditions applies to our agreement.

1 – Products

We sell handmade jewelry, made of sterling silver and 14 carat solid gold.

2 – Payments

The (total) price of the products is indicated in our web shop. In our web shop you can pay by means of PayPal and through direct bank transfer. The shipping costs are for your account.

We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information. Please see the PayPal Privacy Policy for more details.

3 – Delivery

We make sure that the product is delivered at the address that you provided when placing the order. You cannot change the address if we already sent out the package. The order will be shipped after the payment is received by us (via PayPal or bank transfer). PostNL takes care of the distribution. You can trace your package with a track & trace code that we send you after the package is sent out. We do our best to deliver the order as soon as possible. Since the products are handmade, it will take roughly five working days for the order to be shipped. If the order is delayed, we will notify you by e-mail. We are not responsible for lost parcels in the mail. We are not responsible for import taxes and other costs that apply in the country of destination.

4 – Taking care of the jewelry

Afra Amba jewelry pieces are handmade and therefore delicate. Treat the jewelry with care to maximize the lifespan. Do not swim, bathe or shower with the jewelry. Try to avoid unnecessary exposure to heat and moisture where possible. Clean 24 carat gold plated jewelry with a damp towel, do not use chemicals.

5 – Returns

You may always return the unworn product within 14 days after you received it. You can do this by sending an e-mail to info@afraamba.nl. After you received a confirmation from us you have to send the product within 14 days. After we received the product back, you get a voucher worth the purchase price of the returned product. The costs for the return shipment will be for your account. During the period you have to consider whether or not you would like to keep the product, the package and product need to be handled with care. You may only unpack the product and use it to the extent that is necessary to determine whether you want to keep the product. Custom made jewelry (such as rings) and 14 carat solid gold jewelry cannot be returned. A ring that unexpectedly doesn’t fit, can be remade. In that case you can send an e-mail with the request to info@afraamba.nl. We will send you more information about the procedure then. We reserve the right to refuse unreasonable repairs and returns.

6 – Liability

We are not liable for any damage that is caused by the use of a product. This does not apply if the damage was caused by our intent, gross negligence or recklessness. Your right to compensation will in any case be an amount up to the amount of the ordered and paid product.

7 – Intellectual property

All intellectual property rights (such as: copyrights, logos, word marks) on our texts, photos, images and other materials are our property (or we have these in use with the consent of the owner). Your use may not infringe here.

8 – Privacy

Afra Amba can collect personal information from users in various ways. This includes, but is not limited to, information provided when registering, entering data and placing an order. We only collect this information if the user has provided this information. Data are only processed for the execution of the agreement in connection with the delivery of the products.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Your data

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

9 – Complaints procedure

If you have a complaint about the implementation of the agreement, we would like to hear that. Send your complaint as soon as possible (and described as fully as possible) to info@afraamba.nl. We will process your complaint as quickly as possible, at the latest within five working days after we receive your e-mail. If it takes longer to handle the complaint, you will receive a confirmation of your complaint within three working days and we will let you know when we expect a substantive answer. If we cannot resolve the complaint between ourselves, a dispute arises that falls under the dispute settlement.

10 – Dispute resolution

Dutch law applies to these terms and conditions and the agreements that we conclude with you. In case of a dispute, the court in Amsterdam is competent.

We collect information about you during the checkout process on our store.

What we collect and store

While you visit our site, we’ll track:

  • Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
  • Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
  • Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for ten years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

We will also store comments or reviews, if you choose to leave them.

Who on our team has access

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and
  • Customer information like your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.
